Rivers Governance | NBA, Falana Condemn Ibas Over Alleged Disregard for Rule of Law

The Port Harcourt branch of the Nigerian Bar Association (NBA) has strongly criticized the Sole Administrator of Rivers State, Vice Admiral Ibok-Ete Ibas (rtd), accusing him of violating constitutional provisions and undermining the foundations of democratic governance in the state.

In a statement issued by the chairmen of the eight NBA branches across Rivers State, the association expressed deep concern over recent developments under the state’s sole administration model, which was imposed following the declaration of a state of emergency. The NBA condemned Ibas’ interference with constitutionally guaranteed structures, specifically his suspension of duly elected state officials and his recent appointments, which the body described as both unlawful and provocative.

“The actions of the Sole Administrator are injurious to democratic institutions and contravene the principles of governance as enshrined in the Nigerian Constitution,” the NBA said. “We are deeply concerned by the erosion of democratic values in Rivers State and call for an immediate cessation of these unconstitutional activities.”

In a separate but similar statement, renowned human rights lawyer and Senior Advocate of Nigeria (SAN), Femi Falana, also voiced his concerns over Ibas’ actions. Falana urged President Bola Tinubu to immediately remove Ibas from office for breaching the terms of the presidential order that established the state of emergency.

Falana pointed out that Ibas’ actions violated the official gazette of March 18, 2025, which proclaimed the state of emergency in Rivers State. The gazette explicitly mandated that the Sole Administrator “shall operate on the basis of such regulations that may, from time to time, be issued by me (Tinubu).” However, Falana noted, there have been no such regulations issued by President Tinubu, yet Ibas has proceeded with appointing new officials and removing those previously appointed by the elected Governor, Siminalayi Fubara.

“While the state of emergency empowers the Sole Administrator to take necessary actions, it does so within the confines of legal and presidential guidelines,” Falana said. “By acting outside of these guidelines, Ibas has not only violated constitutional principles but also defied the president’s directive. His actions are a direct affront to the rule of law.”

The growing criticism of Ibas’ administration comes amidst increasing concerns about the erosion of democratic structures in the state and the broader implications for governance in Nigeria. Both the NBA and Falana have called for immediate action to restore constitutional order in Rivers State and ensure that all actions taken by the Sole Administrator are in strict compliance with the law.
