The dethroned Apetumodu of Ipetumodu in Osun State, Oba Joseph Oloyede, has sued Governor Ademola Adeleke, seeking a court order to stop the state government from appointing a replacement to the traditional stool pending the determination of a substantive suit.
Oloyede, who was convicted in the United States of America for offences bordering on fraud, is the second claimant in suit number HIF/50/2026 before an Osun State High Court sitting in Ile-Ife.
In a motion on notice dated September 16, 2026, the monarch alleged that Governor Adeleke and relevant state officials failed to formally notify him of any wrongdoing before initiating the process that led to his removal.
He is asking the court to restrain the governor and other defendants, either directly or through their agents, from taking any steps to fill the Apetumodu stool or appoint another person in his place until the substantive suit is heard and determined.
In the application, Oloyede referred to a report published by The Guardian on May 11, 2026, which stated that he had been deposed through an instrument allegedly signed by Governor Adeleke on May 7, 2026.
He argued that he was not informed of any alleged misconduct by the first to third defendants before the publication of his removal and the issuance of the purported deposition instrument.
The motion partly reads: “An order of interlocutory injunction restraining the defendants/respondents either by themselves or through their servants, agents or privies from taking any step to fill the stool of the Apetu (Apetumodu) of Ipetumodu or appoint any person in place of the 2nd claimant who is the occupant of the Apetu’s stool, pending the hearing and final determination of this suit.”
The application further stated that Oloyede was not formally informed of any wrongdoing before the state government’s reported decision to remove him.
Other claimants in the suit are Princes Oyewusi Adewusi, Isaac Adewuni and Abiodun Oyetoro. They instituted the action on behalf of themselves and other members of the Latimogun Royal Family of the Aribile Ruling House of Ipetumodu.
The defendants, alongside Governor Adeleke, include the Osun State Attorney-General and Commissioner for Justice; the Commissioner for Local Government and Chieftaincy Affairs; Chief Afolabi Adedeji; the Asalu of Ipetumodu and head of the kingmakers, Chief Adesoye Babalola; the Malefon of Ipetumodu; and Ife North Local Government.
The suit challenges the circumstances surrounding Oloyede’s removal and seeks to prevent the state government from filling the traditional stool while the legal dispute remains before the court.
